1. Acceptance of Terms

Welcome to SM Taxi Service Goa. By accessing our website at smtaxiservicegoa.com, making a booking, or using any of our services (taxi booking, car rental, bike rental), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these terms, please do not use our services.

These Terms constitute a legally binding agreement between you (the "Customer," "you," or "your") and SM Taxi Service Goa (the "Company," "we," "us," or "our"), operating in Goa, India.

2. Services Overview

SM Taxi Service Goa provides the following transportation services in Goa:

  • • Hourly rental packages (4hr, 8hr, 12hr)
  • • Local sightseeing tours
  • • Outstation travel

🚗 Car & Bike Rental

  • • Self-drive car rental
  • • Self-drive bike/scooter rental
  • • Daily, weekly, monthly packages
  • • Multiple vehicle options
  • • Insurance included

Note: Car and bike rental services may be fulfilled through our partner platforms, which may have additional terms.

3. Booking and Reservations

3.1 Making a Booking

To book our services, you must:

  • Be at least 18 years of age
  • Provide accurate and complete information (name, contact details, pickup/drop-off locations, date/time)
  • Have a valid phone number and email address
  • Accept these Terms of Service

3.2 Booking Confirmation

Once you submit a booking request, you will receive a confirmation via email and/or SMS. Your booking is confirmed only when you receive this confirmation. We reserve the right to decline a booking at our discretion.

3.3 Booking Modifications

To modify or cancel your booking, please contact us at least 24 hours before your scheduled pickup time. Modifications are subject to availability and may incur additional charges. See our Refund Policy for cancellation terms.

4. Pricing and Payment

4.1 Pricing

Our pricing is based on:

  • Vehicle type selected (Sedan, SUV, Tempo Traveller, etc.)
  • Distance traveled or rental duration
  • Time of service (peak hours, holidays may have different rates)
  • Additional services requested (waiting time, extra stops, etc.)

All prices displayed on our website are in Indian Rupees (INR) and include applicable taxes unless otherwise stated. Prices are subject to change without prior notice, but confirmed bookings will honor the quoted price.

4.3 Payment Terms

  • Advance Payment: Some bookings may require advance payment or deposit
  • Full Payment: Payment can be made online at the time of booking or to the driver upon service completion
  • Additional Charges: Any extra charges (waiting time, tolls, parking fees) must be paid directly to the driver
  • Failed Payments: If payment fails, your booking may be automatically cancelled

Important: Additional charges may apply for extra kilometers beyond the agreed distance, waiting time beyond the free period, night surcharges (11 PM - 5 AM), and tolls/parking fees.

5. Customer Responsibilities

✓ Be Present on Time

Be ready at the pickup location at the scheduled time. Drivers will wait for a maximum of 15 minutes free. Beyond this, waiting charges may apply.

✓ Provide Accurate Information

Ensure all booking details (pickup location, destination, contact number) are accurate. We are not responsible for delays or missed services due to incorrect information.

✓ Respectful Behavior

Treat our drivers and vehicles with respect. Smoking, alcohol consumption, and illegal activities are strictly prohibited in our vehicles.

✓ Vehicle Care (Rentals)

For self-drive rentals, you are responsible for the vehicle's care. Any damage, loss, or traffic violations during your rental period will be your responsibility.

✓ Valid Documentation

For self-drive services, you must possess a valid driving license, provide identity proof, and meet age requirements (21+ years for cars, 18+ for bikes).

6. Company Responsibilities and Limitations

6.1 Our Commitments

  • Provide professional and courteous service
  • Maintain vehicles in good working condition
  • Employ experienced and licensed drivers
  • Respond to customer inquiries promptly
  • Ensure driver verification and background checks

6.2 Limitations of Liability

We shall not be liable for:

  • Delays: Due to traffic, weather, road conditions, or circumstances beyond our control
  • Personal Belongings: Loss or damage to items left in vehicles (please check before exiting)
  • Indirect Damages: Consequential losses such as missed flights, events, or business opportunities
  • Third-Party Actions: Incidents caused by other road users or external parties
  • Force Majeure: Natural disasters, strikes, government restrictions, or other unforeseeable events

Maximum Liability: Our total liability for any claim shall not exceed the amount paid by you for the specific service.

7. Cancellation and Refund Policy

Please refer to our separate Refund Policy for detailed information about cancellations, refunds, and associated terms.

Quick Summary:

  • Cancellations more than 24 hours before: Full refund (minus processing fee)
  • Cancellations 12-24 hours before: 50% refund
  • Cancellations less than 12 hours before: No refund
  • No-show: No refund

8. Insurance and Liability

8.1 Taxi Services

All our vehicles are covered by comprehensive insurance as required by Indian law. This insurance covers third-party liability and vehicle damage. Personal injury to passengers is covered up to the limits specified in the insurance policy.

8.2 Self-Drive Rentals

Self-drive rental vehicles include basic insurance. However:

  • You are responsible for any deductible amount in case of accidents
  • Damage due to negligence, violation of traffic rules, or unauthorized use is your responsibility
  • You must report accidents to police and us within 24 hours
  • Additional insurance options are available at extra cost

Travel Insurance: We recommend purchasing separate travel insurance for comprehensive coverage of personal belongings, medical expenses, and trip cancellations.

9. Prohibited Activities

The following activities are strictly prohibited:

🚫 Dangerous Behavior

  • • Drunk driving (rentals)
  • • Rash or negligent driving
  • • Harassment of drivers/staff

🚫 Vehicle Misuse

  • • Racing or stunt driving
  • • Off-road use (unless specified)
  • • Overloading passengers

🚫 Misrepresentation

  • • False identity or documents
  • • Fraudulent bookings
  • • Unauthorized subletting

Consequences: Violation of these terms may result in immediate service termination, legal action, and you will be responsible for all damages and losses incurred.

10. Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, software, and design, is the property of SM Taxi Service Goa or its licensors and is protected by Indian and international copyright and trademark laws.

You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.

11. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our services, you consent to the collection and use of your information as described in the Privacy Policy.

12. Dispute Resolution

12.1 Complaints

12.2 Governing Law

Any dispute or claim arising out of or relating to these Terms that cannot be resolved amicably shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration being in Goa, India.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

We will notify users of material changes through email or a prominent notice on our website.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of law, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and SM Taxi Service Goa regarding the use of our services, superseding any prior agreements.
